Must the award be given through a Special Needs Trust or a Preservation Trust?

In nearly all cases, the individuals in the Patient Class are persons with disabilities who already receive or will in the future receive public benefits like Social Security and Medicaid. These benefits often impose limits for eligibility and receiving a large sum of money from this settlement could impact the individualā€™s eligibility. Special Needs Trusts and Preservation Trusts are financial instruments that can protect the assets and resources of an individual with a disability.
